Fair Usage Rules

We are fair with our customers, so we expect you to be fair with us and other LABAS friends. That's why we created fair usage rules for our services.

Fair usage rules are general requirements for all LABAS service users. Violating these rules will be considered a breach of our agreement.

What is considered unfair use of LABAS services?

It's simple: LABAS is meant for communication with people important to you and for meeting personal needs.

Unfair use includes all calls and SMS that are not intended for communication, as well as sending, receiving, or sharing an unreasonably high volume of SMS, calls, or mobile internet data. It also covers any usage that, due to its nature, scope, or duration, is unusual for typical service users, significantly exceeds the average usage of our customers, and does not resemble rational personal use.

We’ll be good friends if you:

  • Joined us because you want to use LABAS services, not for other reasons.
  • Use the LABAS SIM card only to communicate with others or browse the internet for personal needs.
  • Do not provide communication services to others using LABAS services.
  • Do not seek financial gain at LABAS (or LABAS customers') expense, including reselling our services or parts of them to others.
  • Do not "spam" – i.e., you do not make excessive calls, send unwanted SMS, or misuse LABAS services for business or marketing purposes.
  • Do not try to profit from LABAS or other operators.
  • Use LABAS services (and the provided SIM card) personally and do not allow others to use them without prior LABAS approval. That means you do not use the services, SIM card, or device to transfer data to other users or redirect data to other devices.
  • Do not try to profit from the difference between your applicable tariff, network connection fees, and other market prices.
  • Do not use the LABAS SIM card in equipment prohibited in Lithuania or in devices for which your selected plan is not intended (e.g., using a personal computer, tablet, router, modem instead of a mobile phone).
  • Do not use the LABAS SIM card, phone number, or equipment for any illegal activities, including fraud or abuse. You must ensure that the SIM card, equipment, or phone number is not used for criminal activities.

We want to remind you that violating fair usage rules means breaching our agreement. In this case, we reserve the right to immediately (fully or partially) restrict your LABAS services or offer an alternative payment plan.

We will inform you about service restrictions or proposed alternative plans via written notice, SMS, email, or phone call.

If services are restricted, you will still be able to call emergency number 112 and other free numbers.

Unfortunately, if we detect unfair use of our services, we reserve the right to refuse to provide you with services in the future.

Additional rules for travelers using LABAS services abroad:

For countries where local retail mobile prices are lower than wholesale roaming prices (including Lithuania), the EU has introduced an exception allowing mobile operators to apply rates calculated using the EU institutions' methodology and approved by the local regulator (in Lithuania – the Communications Regulatory Authority).

If you subscribe to the HEYEU1 plan, fair usage rules apply to the services. The service provider may charge for incoming calls if the services are used unusually or unfairly – i.e., significantly deviating from the average user's consumption habits, for purposes other than those intended in the service agreement, or otherwise abusing the services. If you exceed 160 minutes of incoming calls within 37 days (or a shorter period), a fee of 0.01 EUR/min may be applied. Upon renewal or reordering of the call plan, this incoming call limit is reset. To check how many incoming minutes you have used since ordering the plan, call LABAS customer support.

Permanent residence or stable connection to Lithuania:

You can use the GB provided by your plan while traveling in the EU/EEA under the conditions and tariffs described in the plan, provided that you permanently reside in Lithuania or have stable ties with Lithuania, such as frequent and long-term presence within Lithuanian territory. To prevent abuse or unusual usage unrelated to periodic travel, we may ask you to provide proof of residence or ties to Lithuania. If you fail to provide adequate proof, mobile internet usage while traveling in the EU/EEA will be charged at regulated wholesale roaming rates, which you can find [here].

Roaming service usage and duration of stay in other EU/EEA countries:

If, within a 4-month period, we detect based on traffic data that (i) you consume more mobile data in the EU/EEA than in Lithuania, and (ii) you spend more time in the EU/EEA than in Lithuania, further data usage in the EU/EEA will be charged at the applicable wholesale roaming rates if the situation does not change within a 14-day warning period. Such charges may apply if (i) the SIM card is not used in Lithuania for an extended period and is primarily or exclusively used while traveling in the EU/EEA, or (ii) the same person holds multiple subscriptions and uses several SIM cards for roaming services. Days when the subscriber was connected to the mobile network in Lithuania are counted as presence in Lithuania. Days without network connection (e.g., the device was turned off) are not included in the calculation of presence in Lithuania or other EU/EEA countries. Using services or staying outside the EU/EEA is considered equivalent to using services or staying in Lithuania.

Organized resale:

If we detect that a SIM card has been systematically resold to individuals who do not reside in Lithuania and have no other stable connection to Lithuania, we may take immediate action, such as restricting services or applying wholesale roaming rates in the EU/EEA.

If you lose your SIM card, please report it immediately by calling our customer service at 1501 (0.10 €/min). This is the only way we can prevent unfair and illegal use of your SIM card.
